Industrial safety

The Royal Legislative Decree 2/2011, which approves the Revised Text of the State Ports and Merchant Marine Law, establishes in Article 25 the competences of the Port Authorities, one of them being the provision of general services, as well as the management and control of port services under optimum safety conditions.
In addition, in its Occupational Health and Safety Policy, APS aims to prevent and reduce accidents, incidents and occupational illnesses to a minimum by providing the necessary resources.

PROCEDURE FOR THE COORDINATION OF BUSINESS ACTIVITIES

Royal Decree 171/2004 on the Coordination of Business Activities, which develops article 24 of Law 31/1995 on the Prevention of Occupational Risks, establishes the different cases in which the coordination of business activities is necessary, as well as the means of coordination that must be established between concurrent companies in order to reduce occupational accident rates.

 

The means of coordination listed in the procedure that are normally used between concurrent companies in the Port of Santander, without prejudice to other means that may be established, are as follows:

  • Appointment of a Preventive Activities Coordinator.
  • Exchange of information and communications.
  • Celebration of periodic meetings of the Committee for Control and Coordination of Preventive Activities of the Port of Santander.
  • Establishment of working groups.

APPOINTMENT OF A COORDINATOR OF PREVENTIVE ACTIVITIES:

On November 19, 2008, the Board of Directors of the Port Authority of Santander appointed a Coordinator of Preventive Activities whose functions correspond to those established in Article 14 of Royal Decree 171/2004:

  1. To promote compliance with the objectives set forth in Article 3 of RD 171/2004.;
  2. To serve as a channel for the exchange of information among competing companies.
  3. Any other established by the Presidency and Management of APS. 

The functions of the Coordinator of Preventive Activities do not include works that fall within the scope of RD 1627/1997, of October 24, 1997, which establishes minimum health and safety provisions for construction works.


EXCHANGE OF INFORMATION AND COMMUNICATIONS:

The exchange of information and communications is embodied through the use of the different annexes that make up the procedure. These annexes are as follows:

The Port Authority of Santander, regardless of whether it acts as the main or principal employer, informs all companies and self-employed workers working in the Port of Santander Service Area, prior to the start of the activity, of the risks inherent to the work center, prevention measures to be applied and emergency measures. The information is provided through the delivery of the document called GENERAL RISKS OF THE PORT OF SANTANDER SERVICE ZONE, being the delivery of such documentation recorded through Annex I of POC-17.

For their part, all companies and self-employed workers who have submitted Annex I are, in turn, obliged to inform all companies or self-employed workers they hire about the risks, preventive measures and emergency measures, either for sporadic work (Annex V) or for regular work (Annex VI).

External visitors who have to access the port must also be informed of the risks, which is evidenced by Annex VII (external visitor certificate) and Annex VII-bis (Annex VII in English).

In addition, the concurrent employers are obliged to inform the others in writing both in the event of an accident at work (Annex III) and in the event that a situation of potential risk is detected (Annex IV). All companies contracted to carry out works or services for the Port Authority of Santander must be informed of the General Risks, Preventive Measures and Measures to be adopted in emergency situations, and deliver the documentation and annexes specified in Industrial Safety and PRL, prior to the start of the work.

PLATFORM FOR COORDINATING BUSINESS ACTIVITIES WITH THE PORT AUTHORITY OF SANTANDER

One of the means of the Coordination of Business Activities used at the Port of Santander is the exchanging of information and documentation by means of emails. 
With the aim of progressing towards the digitalisation of the various processes of the Port of Santander and making the administration of the documentation by both companies and workers more flexible, the Port Authority of Santander (PAS) has implemented a virtual platform known as “eGestiona”. This will be used for saving and administering all the documentation on the prevention of occupational hazards of both the companies carrying out work or providing services for the PAS and those for which the Service Area of the Port of Santander is their workplace.
